On June 26, 2017, outside legal counsel for FWISD responded to the "demand letter" (see second letter below) basically asserting the District is not in violation of Title IX and believes it is meeting the needs and interests of it students. And, that "Fort Worth ISD is taking immediate measures to evaluate and reinforce its Title IX efforts to facilitate continued compliance with Title IX's mandates". The problem here is that prior to the girls demand letter and surely after it, information was provided to the District to justify the adoption of rugby as girls' varsity sport through participation numbers, sign-up sheets, and sufficient competition within the geographic area. All points the attorney suggested may be reasons for not instituting the sport. It also needs to be pointed out the in terms of FWISD offering club / intramural sports that publicly available participation numbers demonstrate that the most visible athletic activities greatly serve the interest and needs of male students (athletes) over those of female students: fall baseball, 7-on-7 football, and powerlifting.
